The Ramdev Platform is owned and operated by Ramdev Medical, incorporated under the Companies Act, 2013. By using our platform, you confirm your acceptance of these terms. If you do not agree, please refrain from using the Ramdev Platform. Our platform enables customers to purchase pharmaceutical products, including prescription medications and medical devices.

1. Eligibility

When using the Ramdev Platform, you affirm that you meet the following eligibility criteria:

a. You are at least 18 years old, or you are using the platform under the supervision of a parent or guardian, who will be regarded as the end-user of the services.

b. If you are under 18, your parents or legal guardians can transact on your behalf if they are registered users. You are prohibited from purchasing items meant for adults only.

c. You are legally capable of entering into a contract and competent to receive the services provided.

d. You have not been previously suspended or disqualified by Ramdev Medical or any affiliated entity.

e. We reserve the right to terminate your access if we discover you are under 18.

f. These Terms and Conditions are governed by Indian laws, including but not limited to:

2. Our Services

Through the Ramdev Platform, we provide the following services ("Services"):

a. The display, advertisement, sale, and delivery of medications, including over-the-counter products and other healthcare items.

b. Any additional services that may become available on the platform from time to time. Transactions for products on the Ramdev Platform are solely conducted by us, and you acknowledge that any legal remedies can only be sought against Ramdev Medical.

3. Your Use of the Ramdev Platform

3.1 By using the Ramdev Platform, you agree to comply with these Terms and Conditions. If you disagree with any part, please do not access the platform.

3.2 This document is an electronic record as defined by the Information Technology Act, 2000, and does not require a physical signature.

3.3 As a user, you agree to the following conditions:

3.3.1 Due Diligence:

a. You are responsible for the medical and personal information you provide and should use discretion when doing so.

b. You must provide accurate information to receive services.

c. You are responsible for all activities conducted using your account and must keep your login details secure.

d. Your information may be used for service-related purposes, including analysis and legal compliance.

e. We reserve the right to refuse service if you violate these terms.

3.3.2 Scope of Services:

a. We sell various products, including medicines and healthcare items, through our licensed stores.

b. The platform will show available inventory based on the pin code you enter.

3.3.3 Prohibitions:

a. You may only use the platform for lawful purposes and cannot exploit it for commercial gain without our written permission.

b. You must not impersonate any individual or entity or misrepresent your identity.

c. Uploading prohibited content is not allowed, and you cannot resell products purchased from us.

d. You are limited to one upload of a prescription unless it has been re-prescribed.

3.3.4 Delivery and Charges Policy:

a. We aim to deliver within the communicated timeframes but do not guarantee exact delivery times due to various factors.

b. We will not be liable for delays or errors caused by incorrect information you provide.

c. If no one is available to receive the order, we will not be liable for theft or damage.

d. Delivery charges will be shown during checkout.

e. Cash on Delivery (COD) is available; however, payment must be made upon delivery.

f. We will notify you when your order is confirmed and shipped.

g. If we cannot ship your order within 36 hours, we will cancel the unshipped portion and refund you.

h. All refunds will be processed per our Payment, Returns, and Refund Policy.

3.3.5 International Delivery:

Currently, we do not offer international delivery. Orders must have shipping addresses in India.

3.3.6 Additional Information:

a. We reserve the right to cancel any orders prior to dispatch.

b. You will be responsible for any additional charges incurred for redelivery due to your errors.

3.3.7 Medicine Delivery Policy:

a. A valid prescription must be uploaded for all medicine orders unless exempted by law.

b. You may not upload the same prescription multiple times unless re-prescribed.

c. Medicines will be dispensed under the supervision of a licensed pharmacist.

d. You agree that your prescription details will be recorded in compliance with applicable laws.

e. You may be required to present your prescription during delivery.

f. We reserve the right to reject your order if the prescription does not meet statutory requirements.

4. Prohibited Content

You must not upload or distribute any content that:

a. Infringes on the rights of others.

b. Is harmful, defamatory, or violates any laws.

c. Misleads or impersonates others.

d. Incites any offense or disrupts public order.

Failure to comply may result in the removal of your content and termination of your access to our services.

5. INDEMNIFICATION

a. By engaging with the RM Platform and/or the Services, you agree to indemnify, defend, and hold harmless RM, its affiliates, and any RAMDEV group companies, including their directors, officers, employees, agents, contractors, and licensors, from any claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

b. Your breach of these Terms;

c. Your usage of the RM Platform and/or Services;

d. Any inaccuracies in the credit/debit card information you provide;

e. Use of a credit/debit card that you do not lawfully own;

f. Allowing a third party to access your account using your password;

g. Your failure to comply with relevant laws or regulations in the jurisdiction where you access the RM Platform and/or Services;

h. Submission of a false, forged, unauthorized, or manipulated prescription;

i. Any actions taken by RM during investigations into suspected breaches of these Terms.

6. LIMITATION OF LIABILITY

By utilizing our Services, you acknowledge and agree to the following limitations:

a. To the maximum extent permitted by law, RM and its affiliates will not be liable for any special, indirect, incidental, or consequential damages related to:

• These Terms and Conditions and the Privacy Policy;
• Your ability or inability to use the RM Platform;
• Your interactions with any third-party services accessed via the RM Platform.

b. RM does not guarantee that the RM Platform or any Services or Products will be error-free or uninterrupted. There may be delays, omissions, interruptions, or inaccuracies in the available materials or Services.

c. While RM takes precautions to prevent the introduction of harmful components such as viruses, we do not guarantee that the RM Platform and associated Services are free from such features. RM is not liable for any damages resulting from them.

d. To the fullest extent allowed by law, RM is not liable for any losses or damages incurred, including lost profits or data, arising from your use of the RM Platform, the information or Services provided, or any actions of RM’s agents or third parties.

e. RM disclaims all warranties, whether express or implied, regarding the RM Platform and its Services, including any implied warranties of merchantability or fitness for a particular purpose. You use the RM Platform at your own risk.

f. In no event shall RM’s total liability for any claims related to your use of the RM Platform exceed the amount you paid for the Products or Services in question.

g. RM reserves the right to refuse Service, terminate accounts, modify content, or cancel orders at its discretion.

h. Any claims related to your use of the RM Platform must be filed within one (1) year of the incident.

i. Products offered are intended for personal use only. If you plan to use them for business purposes, ensure you have appropriate insurance. RM limits its liability to the replacement value of the Products for business users and disclaims any warranty regarding their fitness for business use.

This section remains effective even after the termination of this Agreement or your use of our Services or the RM Platform.

7. DATA & INFORMATION POLICY

At Ramdev Medical, we deeply respect your privacy and are committed to protecting your personal information. Any data you provide to us in order to access our services is safeguarded in accordance with our Privacy Policy. 8. INTELLECTUAL PROPERTY AND OWNERSHIP

You acknowledge and agree that all copyrights, trademarks, and other intellectual property rights related to the materials or content provided through the Ramdev Medical platform are owned by us or licensed to us by third parties. You are granted permission to use this content only as explicitly authorized by us or our licensors. Any unauthorized use of the content, including copying, reproduction, or commercial exploitation, is strictly prohibited without prior written approval from Ramdev Medical. All trademarks, product names, and service names, whether highlighted through unique typography or capitalization (referred to as "Marks"), are owned by or licensed to Ramdev Medical unless otherwise stated. These Marks are protected under Indian law, and their use requires written consent from Ramdev Medical, except for the sole purpose of identifying our products or services.

You further agree that the material available on the Ramdev Medical platform is for your personal, non-commercial use only. You may download the content solely for the purpose of accessing our platform. Any other use, including copying, transmission, distribution, or the creation of derivative works, is strictly prohibited.

Additionally, Ramdev Medical provides the option for registered users to submit reviews, suggestions, questions, or other content ("User Content"). By submitting User Content, you warrant that it is original and does not infringe on any third-party rights. You also grant Ramdev Medical a perpetual, royalty-free license to use, modify, and distribute this content as we see fit, without any further obligation to you. Ramdev Medical reserves the right to monitor, edit, or remove any User Content at its discretion.

9. OTHER CONDITIONS

By using our platform, you agree to the following:

a. You will use our services, and those provided by our affiliates, consultants, and contracted companies, solely for lawful purposes and in compliance with all relevant laws and regulations.
b. You will provide accurate, complete, and current information when requested. Ramdev Medical reserves the right to verify the information provided. If found to be false, we reserve the right to reject your registration and restrict access to our services.
c. You acknowledge that any transaction made through our platform is done at your own risk, using your best judgment.

Ramdev Medical reserves the right to assign or subcontract any of its rights or obligations under these terms to third parties. If any provision of these terms is deemed unenforceable, the remaining terms will remain in effect. No delay or failure by Ramdev Medical to enforce any of its rights will be considered a waiver of those rights.

Ramdev Medical has no control over these third-party resources and is not responsible for their content or any losses or damages that may result from their use. 12. EVENTS BEYOND OUR CONTROL (FORCE MAJEURE)

We will not be held liable for any delay or failure to fulfill our obligations under these terms caused by events beyond our control, including but not limited to strikes, civil unrest, natural disasters, or government actions. During such events, our obligations will be suspended, and we will communicate any necessary extensions to our service timelines.

13. TERMINATION

a. We reserve the right to immediately discontinue your access to our services if your conduct is deemed unlawful or in violation of these terms.
b. In the case of legal or regulatory changes, we reserve the right to modify or suspend services as necessary.

14. APPLICABLE LAW AND JURISDICTION

The use of the Ramdev Medical platform and any associated contracts are governed by Indian law, and any disputes will be subject to the exclusive jurisdiction of the courts in India.
